1. About this policy

This AI Usage Policy explains how Plyn AI and the other AI features in Packlyn Design Software, including its online version, work, who processes your requests, what you may and may not use them for, and your responsibilities for what they produce. "Packlyn", "we" and "us" mean Packlyn Canada, a print business in Cambridge, Ontario, Canada. This policy forms part of the Terms of Service and should be read with the AI Features Terms and the Privacy Policy. The Plyn chat on the website packlyn.ca is covered by the separate Plyn AI Assistant Terms & Conditions (https://packlyn.ca/plyn-terms/).

2. What Plyn AI does and who can use it

Plyn AI helps you write text, choose colour palettes, create whole designs and design content, make vector artwork and get answers in the Plyn chat. When Packlyn has switched these services on, it can also generate pictures and do enhanced upscaling.

What Plyn AI creates (writing, colour palettes, designs, vector artwork and pictures) is available on Pro. Plyn's chat answers are open to everyone, on Free and Pro and without an account, the same way Plyn answers on the packlyn.ca website: online, Claude, by Anthropic, answers. When Plyn can't answer online, it gives built-in help answers from knowledge inside the app and can do free web look-ups through DuckDuckGo and Wikipedia, which send only the text of your question.

Some AI tools run entirely on your device (in the online version, in your browser): remove background, smart cut-out, object eraser, auto-enhance and included Image Upscaling (Real-ESRGAN). These don't send your pictures anywhere. Every AI tool is part of Pro; the Free plan does not include them. The app's free photo search uses Openverse; your search words are sent, and the results are public-domain or CC0 pictures.

3. No credits and fair use

There are no AI credits. Plyn AI and Image Upscaling are included with Pro, with no monthly allowance, and nothing is ever charged to you for AI use. Plyn AI has fixed daily amounts of pictures, designs, writing, colour palettes and vector art. Fair use applies: a short per-minute limit stops bursts of requests and automated abuse, and Packlyn has an overall monthly spending limit for its AI providers. If that limit is reached, the AI features pause until it resets. If an operation fails, it simply doesn't count for anything. The AI Features Terms explain this in full.

4. Who processes your requests

Requests go through Packlyn's server, which holds the access keys; the app never connects to these providers directly. The providers process requests under their own terms and policies, and may keep data as their terms allow. Information may be processed and stored outside Canada, including in the United States, where the laws may allow access by authorities.

5. What is sent and what Packlyn keeps

When you use Plyn AI, the description you type and the options you choose (such as format, style, brand name and details you type) are sent to the provider. For enhanced upscaling, the picture is sent.

Packlyn's server does not store your prompts, the AI's answers or pictures. It keeps a record of each request with the kind of request, the model used, token counts, the estimated cost, whether it succeeded and the time. We use these records for spending limits, abuse prevention and administration. The Privacy Policy explains how long records are kept and your privacy rights.

Your designs, including AI output you add to them, are stored on your device and, with Pro when you are signed in, saved to your account. They leave your device only when you save them to your account, send a quote request, or use Plyn AI (your description) or enhanced upscaling (the picture).

Don't include sensitive personal information in prompts, such as health information, government identification numbers, financial account or card numbers, passwords, or other people's personal information without their permission.

6. Permitted uses

You may use Plyn AI to help create designs for personal and business use, including commercial designs for your own business or for your clients, as long as you follow this policy, the Terms of Service and the law.

7. Prohibited uses

You must not use Plyn AI or any AI feature to:

Packlyn may refuse a request, restrict AI features or suspend an account that breaks this policy. A provider may also refuse a request.

8. Accuracy and limitations

AI output can be wrong, incomplete, similar to existing works or unsuitable. It can invent details, misspell words or get facts, prices, dates and contact details wrong. Plyn AI does not know your business unless you tell it, and its answers are not legal, financial or other professional advice. Image Upscaling makes pictures 2×, 4×, 6× or 8× larger (enhanced upscaling only 2× or 4×), but it can't recover detail that was never in the picture.

9. Your responsibility and human oversight

Plyn AI suggests content; it does not make decisions about you, and you decide whether to use, edit or discard what it produces. You must review all AI output before you use it, and you are responsible for what you publish or print. Check spelling, facts, claims and contact details, and make sure the result suits its purpose.

Because Packlyn doesn't store prompts or output, Packlyn does not review your AI content. Packlyn reviews only the request records described in section 5.

10. Print suitability

AI-generated pictures and upscaled pictures may not be sharp enough, or have the right colours, for professional printing. Before printing, check resolution, bleed, colours and text. Downloads on the Free plan are at standard resolution (72 DPI) and may not meet professional print resolution. Printing orders are separate agreements with Packlyn Canada, made through a quotation.

11. Ownership, copyright and commercial use

Your content stays yours. Packlyn gets only the permission needed to process the AI requests you start.

You may use AI output in your designs, including commercial designs, subject to this policy, the rights of others and the law. Packlyn does not guarantee that any AI output is unique or free of third-party rights; other people may receive similar output. Whether AI output can be protected by copyright depends on the law and on your own creative contribution. Before you print, publish or use output as a logo or brand, you are responsible for checking that it doesn't copy or closely resemble someone else's work, trademark or likeness.

To report content you believe infringes your copyright, email packlyncanada@gmail.com with the details of the work and where it appears.

12. Availability

AI services may be unavailable at times, for example because of a provider outage, maintenance, or Packlyn's monthly spending limits for AI services. If an operation fails, it doesn't count for anything.

13. Reporting a problem output

If Plyn AI produces something harmful, offensive, infringing or clearly wrong, please tell us. Email packlyncanada@gmail.com with your account email address, the date and time, the tool you used, and a description or screenshot of the problem. Because Packlyn doesn't store prompts or output, a screenshot or copy of the output helps us understand what happened. Please don't include sensitive personal information.

14. Governing law and your rights

This policy is governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer, nothing in this policy takes away any rights that the consumer protection law of your own province or territory, including Quebec, gives you.

15. Changes to this policy

We may update this policy, for example when we add, change or switch on an AI provider. Each version shows a version number and an effective date at the top, and your account records which version of each document you accepted and when. If a change significantly affects how your information is handled, we will let you know by email or in the app before it applies.
