Packlyn Design Software

Terms of Service

Effective date: November 3, 2026. Version 1.

Effective date: November 3, 2026

Version 2.1

These Terms of Service (the "Terms") are a legal agreement between you and Packlyn Canada ("Packlyn", "we", "us" or "our"), a print business in Cambridge, Ontario, Canada.

1. About these Terms

These Terms apply to Packlyn Design Software, our design app for Windows and macOS, and to its online version, which runs in a web browser at https://accounts.packlyn.ca/app/ (together, the "App"). They also apply to your Packlyn account and to the online services that work with the App, including saving designs to your account, Plyn AI, Pro subscriptions and Print With Packlyn quote requests (together with the App, the "Service"). The desktop app and the online version share one account, the same designs and the same plans.

The website packlyn.ca has its own Privacy & Cookie Policy (https://packlyn.ca/privacy/) and Plyn AI Assistant Terms & Conditions (https://packlyn.ca/plyn-terms/), which apply to the website and its Plyn chat.

When you create a Packlyn account, you check a box that says "I agree to the Terms of Service and acknowledge the Privacy Policy." The box is never checked in advance, and your account records which version of each document you accepted and when. If you use the App without an account (guest mode), these Terms apply to that use. If you do not agree to these Terms, please do not use the Service.

If you use the Service for a business or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.

2. Other documents that apply

These documents also apply to the Service, and you can read them in the App under Legal and Policies:

Together with these Terms, they form your agreement with Packlyn, except that the Privacy Policy, the Cookie Policy, the Data Retention Policy and the Security and Privacy Contact page describe our practices and you acknowledge them rather than agree to them. If a document on a specific subject, such as billing or AI features, is inconsistent with these Terms, that document applies to its subject. Nothing in any of them reduces your rights under consumer protection law.

Printing orders are separate agreements with Packlyn Canada, governed by Packlyn's quotation and order terms and not by these Terms (see section 11).

3. Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to create a Packlyn account. If you are younger, you may use the App only with a parent or guardian's permission, and you may not buy anything through the Service.

The Service is not directed to children under 13, and we do not knowingly collect their personal information. You may not use the Service where the law does not allow it, or if we have closed your account for breaching these Terms, unless we agree in writing.

4. Accounts

4.1 Guest mode and free accounts

You can design in the App without an account. In guest mode you cannot download or keep designs, and guest designs are deleted when the App closes. A free account lets you download designs, keep them on your device and send quote requests. Saving designs to your account (cloud storage) is part of Pro. To create one, you give your name, email address and a password, and confirm your email address with a 6-digit code.

4.2 Account security

Give accurate information and keep it up to date. Keep your password private, and tell us promptly if you think someone has used your account without permission. You are responsible for activity under your account, except activity caused by our own failure to take reasonable security measures. Two-step sign-in is available, and we recommend using it.

Each account is for one person. You must not share your sign-in details or let anyone else use your account.

4.3 Emails

We send account emails, such as sign-in codes, receipts and security notices, when they are needed. We send marketing emails only if you check a separate, optional box, which is never checked in advance and is not required to create an account. Every marketing email has an unsubscribe link, and you can turn marketing emails off at any time in My Account › Privacy And Data.

5. Your responsibilities

You agree to:

Free plan downloads are PNG and JPG files at standard resolution (72 DPI, up to 1,600 pixels) without bleed, so they may not meet professional print resolution. Before a Free account sends a quote request, the App says so, and you must choose "Continue to Quote" to go ahead.

6. Software access and licence checks

The App is licensed, not sold, under the End User Licence Agreement. The features you can use depend on the plan of the account you are signed in with.

The App checks your plan using signed plan tokens issued by Packlyn's servers. You must not try to unlock paid features, or get around download, AI fair use or other limits, by editing files, settings or tokens, changing the App, interfering with its connection to our servers or any other method.

The desktop app checks for updates signed by Packlyn, and you choose when to install them. The online version is updated by Packlyn on its server.

7. Subscriptions and billing

7.1 Plans

There are two plans, Free and Pro. Prices are in Canadian dollars, plus taxes. Prices and full plan details are in the Subscription and Billing Terms and are shown before you pay. In summary:

On the Free plan, the monthly download count runs from the date you signed up.

7.2 Test and promotional access

Packlyn may give some people free or reduced-price access to Pro, for example for testing, promotions, promo codes or support. It includes the features, and lasts for the period, that we tell you. It has no cash value and cannot be transferred. If no period was set, we may end it at any time.

7.3 Payment, renewals and taxes

Card payments are processed by Square. You enter your card in Square's secure card form on Packlyn's payment page; your full card number and security code go to Square and never reach Packlyn's servers. Square keeps the card on file for your account. Payments can also be arranged directly with Packlyn, for example in the shop or by Interac e-Transfer, and Packlyn records them on your account.

Pro starts the moment your payment is completed. Each period is counted from that moment: 30 days for monthly, 365 days for annual. With Auto-Pay on (it is ticked on the payment page, and you can untick it), Pro renews automatically at the end of each period until you turn Auto-Pay off or cancel, and you authorize Packlyn, through Square, to charge the card on file for each renewal at the price that then applies, plus taxes. With Auto-Pay off, nothing is charged automatically and Pro ends at the end of the period you paid for. Before paying you must agree to these terms and the Subscription and Billing Terms and confirm your age. Applicable sales taxes (GST, HST, PST or QST) are worked out from your billing province or territory and shown before you pay.

If a renewal payment fails, your subscription shows "Payment Failed", we email you, and you keep Pro during a grace period (normally 7 days) while we try the card again and you can update it in My Account. If the payment still can't be collected, Pro ends and your account moves to the Free plan.

7.4 Price changes

We will give you at least 30 days' notice by email before a new price applies to your existing subscription, and you can cancel before it applies. A price change never affects a period you have already paid for.

7.5 Plan changes and cancellation

You manage your subscription from My Account. You can turn Auto-Pay off or on with its switch in My Subscription. You can switch between monthly and annual; the switch takes effect at your next renewal. You can cancel at any time. Pro continues to the end of the period you paid for, and then your account moves to Free. Cancelling stops renewals but does not by itself refund the current period.

7.6 Refunds

Refunds are never made automatically. To ask for one, use "Request a refund" in My Account › My Subscription (shown once you have paid for Pro), or email packlyncanada@gmail.com. A person at Packlyn reviews every request and decides whether to give a full refund, a partial refund or no refund. Duplicate or mistaken charges are always corrected. The Refund Policy explains this in full. This does not affect any right you have to dispute a charge with your card issuer.

8. Plyn AI and the AI features

Plyn AI and Image Upscaling are included with Pro. There are no AI credits and no monthly allowance, and nothing is ever charged to you for AI use. Plyn AI has fixed daily amounts of pictures, designs, writing, colour palettes and vector art; the AI Features Terms explain them. Free accounts cannot use Plyn AI.

Fair use applies. A short per-minute limit stops bursts of requests and automated abuse, and Packlyn has an overall monthly spending limit for its AI providers. If that limit is reached, the AI features pause until it resets. If an AI operation fails, it simply doesn't count for anything.

The AI Features Terms and the AI Usage Policy give the full rules.

9. Your content

9.1 Ownership and permission

Your content means the designs you make, the files you upload, the text you type (including descriptions for Plyn AI), the files you send with quote requests and the messages you send us. As between you and Packlyn, it stays yours.

You give Packlyn a non-exclusive, royalty-free permission to store, copy, process, transmit, display and print your content only as needed to provide the features you use (saving designs to your account, quote requests and printing, and AI requests you start) and to handle reports, security issues and legal requirements about it. This permission ends when you delete the content or your account, except that quote requests are kept as business records, deleted data leaves our backups within the backup cycle, and we keep what the law requires.

9.2 Where it is stored

Designs are kept on your device: on your computer in the desktop app, or in your browser's storage in the online version. Free Plan: Designs can only be saved to your device. Cloud storage is exclusively available with the Pro Plan: save up to 50 designs online and access them from anywhere. With Pro, when you are signed in, designs are also saved to your account automatically. Designs saved to your account are stored, encrypted, on Packlyn's own servers. A Pro account can save up to 50 designs; with all 50 in use, a new design stays on your device until you delete one from your account. Designs saved to your account stay there until you delete them, and a design is never deleted because a paid plan ends: if Pro ends, you can still open, download and delete the designs already in your account, but new changes are saved on your device only. When Packlyn's server needs room, designs in the Trash and earlier saved versions may be deleted sooner, oldest first, but the current version of every design you keep is not deleted. If saving to accounts is ever paused while Packlyn makes room on its server, your design stays on your device and is saved to your account by itself later. You can download any design, or all of them at once, to your computer at any time.

Deleted designs go to the Trash, where they are kept for up to 15 days before they are deleted permanently. The newest 20 versions of each design are kept by default, and Pro includes version history to open and restore them. Nothing is deleted because Pro ends.

Designs leave your device only when you save them to your account, send a quote request, use Plyn AI (your description and options are sent) or use enhanced upscaling (the picture is sent). Files we store are kept under random names and served only to you.

9.3 Uploaded artwork

When you upload files, you confirm that you own them or have permission to use and print them as you intend. Uploads are checked and may be scanned for viruses. We may refuse or remove uploads that breach these Terms or the Acceptable Use Policy.

9.4 Generated content

AI output can be wrong, similar to existing works or unsuitable. Review it before you use it; you are responsible for what you publish or print. We do not guarantee that AI output is accurate, unique or free of third-party rights. Image Upscaling makes pictures 2×, 4×, 6× or 8× larger but cannot recover detail that was never in the picture.

10. Intellectual property

The App, the templates, illustrations, icons and elements made for Packlyn Design, and the Packlyn and Plyn names, logos and the Plyn character belong to Packlyn Canada or its licensors. These Terms do not transfer them to you.

You may use the templates, illustrations, icons and elements in designs you make, including commercial designs for your own business or for clients, but you may not redistribute or resell them as templates or stand-alone assets. Bundled fonts are open-source fonts under the SIL Open Font License 1.1 or the Apache License 2.0. Third-party notices are in the App under Legal and Policies › Third-Party Notices. The End User Licence Agreement and the Copyright and Intellectual Property Policy give the details.

11. Print With Packlyn

With an account, you can send a Print With Packlyn quote request from the App. Nothing is charged in the App for printing; Packlyn replies with a quotation. If you go ahead, your printing order is a separate agreement with Packlyn Canada, governed by Packlyn's quotation and order terms and not by these Terms. Packlyn may decline any print job, including one that would breach the Acceptable Use Policy or the law.

12. Third-party services

The Service relies on third-party providers, including:

The providers process requests under their own terms. We are not responsible for third-party services or content that we do not control. The Privacy Policy explains what is shared with providers.

13. Service availability and changes

The desktop app runs on your computer, but its online parts (signing in, saving designs to your account, Plyn AI, enhanced upscaling, quote requests and billing) need an internet connection. The online version needs an internet connection to open, and it keeps designs on your device while you are offline and saves them to your account when you are back online. AI features depend on third-party providers and may be unavailable because of provider outages or Packlyn's monthly AI spending limits.

We do not guarantee any level of uptime, or that the Service will be uninterrupted or free of errors. We may interrupt it for maintenance or security, and events outside our reasonable control may affect it.

We may add, change or remove features. If a change significantly reduces what Pro includes, we will tell you in advance where we reasonably can, and you may cancel.

14. Suspension and termination

You can stop using the Service at any time and delete your account from My Account. If you have a paid Pro subscription, the App asks you to choose Keep My Subscription (nothing is deleted) or Delete Immediately (Pro ends at once and no further payments are taken). Payments already made are not refunded automatically, and you can ask for a refund under the Refund Policy. You can restore the account by signing in within 30 days. After that, your data is deleted as described in the Data Deletion and Account Closure Policy, except billing and tax records, which are kept as long as the law requires.

We may suspend or limit your access to the Service or parts of it (such as Plyn AI, uploads or downloads), or close your account, if:

Where appropriate, we will tell you why and give you a chance to respond or fix the problem first, unless notice would be unlawful, would create a security risk or would allow harm to continue.

When your account is closed, you can no longer use account features. If we close it because of a breach, your licence to use the App also ends. If we close it for any other reason, refunds follow the Refund Policy and applicable law. Sections 9, 10, 15, 16 and 17 continue to apply.

15. Warranties

To the extent the law allows, the Service is provided "as is" and "as available", without other warranties or conditions, express or implied, including of merchantability, fitness for a particular purpose or non-infringement. We do not promise that the Service will meet all your needs, work on every computer or browser, or be free of errors, interruptions or security incidents; that AI output will be accurate or suitable; that colours and sizes on screen will exactly match print; or that Free downloads will meet professional print resolution. No system is completely secure.

If you are a consumer, consumer protection law may give you warranties or conditions that cannot be excluded. Nothing in these Terms removes them.

16. Limitation of liability

To the extent the law allows, Packlyn is not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, business, goodwill or data, arising from the Service, or for failures caused by events outside its reasonable control. Packlyn's total liability for all claims relating to the Service is limited to the greater of the amount you paid Packlyn for the Service in the 12 months before the claim, or CA$50.

These limits do not apply to liability that the law does not allow to be limited or excluded, which may include liability for fraud, intentional or gross fault, or personal injury. They do not affect your rights under the consumer protection law of your province or territory. Liability for printing orders is governed by Packlyn's quotation and order terms.

17. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer, you keep any rights given by the consumer protection law of the province or territory where you live, such as Ontario's Consumer Protection Act or Quebec's Consumer Protection Act.

If you have a problem, please contact us first at packlyncanada@gmail.com or through https://packlyn.ca/contact/. Tell us what happened and what you would like us to do, and we will try to resolve it informally. If we cannot, either of us may take the dispute to the courts of Ontario or, if you are a consumer, to the courts where you live if your consumer protection law allows it. These Terms do not require arbitration and do not take away any right to take part in a class action.

18. Changes to these Terms

We may update these Terms. Each version has a version number and an effective date. We will tell you about a material change by email or in the App at least 30 days before it takes effect, unless the law allows a shorter period and the change is needed sooner for legal or security reasons. If you do not agree, you can cancel and stop using the Service before the change takes effect. We may ask you to accept the new version, and your account records the version you accepted. Any additional rights that consumer protection law gives you when a contract changes still apply.

19. General

These Terms and the documents listed in section 2 are the whole agreement between you and Packlyn about the Service, apart from any printing order. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. You may not transfer your account or these Terms. We may transfer these Terms to a business that takes over the Service, and we will tell you if that happens. We send notices to your account email address or in the App, and you can send notices to packlyncanada@gmail.com.
